Immediate extension of the insurance obligation for third-party liability for all agricultural vehicles, even if stationary or not in use on the road, and a simultaneous ministerial call for a technical roundtable to address the issues related to the implementation of the so-called “static risk” regulation. These are the requests that emerged from the meeting of the agricultural sector held today at the Confcommercio Roma headquarters, organized by Federacma, the Confcommercio Federation of national associations of agricultural and gardening machinery dealers, which first raised the issue.
Since last July, all owners of agricultural vehicles located in private areas and in the countryside have been required to obtain insurance to protect against the so-called “static risk.” This regulatory change was introduced by a legislative decree from the Ministry of Transport, implementing a European directive, at the end of 2023, on which Parliament had introduced an implementation deferral with the “Milleproroghe” decree, due to the absence of suitable and functional insurance tools. This stalemate remains unresolved.
In addition to Federacma, representatives from agricultural associations such as Confagricoltura, CIA, Copagri, as well as contractors from CAI Agromec and UNCAI (which submitted a contribution) participated in the meeting. The collective request is for the immediate suspension of the regulation with an extension to protect businesses, along with a simultaneous ministerial call for a technical roundtable that can open a discussion on the aspects that need clarification, such as the types of vehicles affected, their intended use, the available insurance tools, and their cost, which should remain affordable to avoid further burdening company budgets. This roundtable should include the involvement of ANIA, the national association of insurance companies, and IVASS, the independent administrative authority overseeing the Italian insurance market.
The requests will be included in a shared document, which will then be submitted to IVASS for consideration. After review by the authority, the relevant Ministries will be asked to convene the technical roundtable as soon as possible, also given the insufficient involvement of stakeholders during the drafting phase of the regulation.
